TERMS AND CONDITIONS

Application
Interested Allottee shall submit application on the prescribed APPLICATION FORM duly signed by him/her along with booking money. BC reserves the right to accept or reject any application without assigning any reason.
 
Allotment
Allotment will be made on first come first served basis. On acceptance of application and booking money, BC will issue a deed of agreement for allotment to the applicant on receipt of which he/she will start making payments as per the schedule of payments in the agreement. Allottee willing to make a one time payment will be entertained with substantial discount. Allottee shall have no right to transfer the allotment to the third party.
 
Payment
All payments shall be A/C Payee Cheque or Bank Draft or Pay-order or Cash in favour of "BASHATI CONSORTIUM LIMITED". Bangladeshis residing abroad may remit payments by TT or DD or Wire Transfer to BASHATI CONSORTIUM LIMITED in the following account:

Penalty
Allottee must strictly follow the payment schedule. BC may issue reminders to the Allottee for delay in payment beyond due date. The Allottee is liable to pay a delay charge @ 3% per month on default payment. If the payment is delayed beyond 2 (two) months BC shall have the right to cancel the allotment and the amount paid by the allottee will be refunded after reselling the flat to new prospective buyer and retaining 20% of the paid amount as penalty.
 
Company's Right
The Company may make minor changes in the design both Architectural and Structural of the project; should these become necessary for benefit of the purchasers. Limited changes in the specification and facilities may be made by BC for overall interest of the project.
 
Refund
For any reason beyond the control of BC like force majeure, natural calamities, political disturbances, army movement, strikes, Acts of God or economic conditions, etc., the company may be bound to abandon the project. In such an event Allottee will be entitled to get refund of all installments along with the booking money already paid by him/her.
 
Utility Connection
Connection fees, security deposit for Water, Sewerage and Electricity and incidental expenses relating to these shall be initially paid by the company (BC) to the concerned authorities on Allottee's behalf. Allottee shall reimburse the same to the company proportionate to his/her share.
 
Additional charges
Additional charges has to be paid by the allottee for any optional works made by the him/her.
 
Transfer of Ownership
Proportionate share of undivided and undemarcated land along with the apartment will be registered in favour of each allottee. In case the project is registered in the name of a limited company the allottee will get proportionate share of the company.
 
Transfer Cost
All costs relating to transfer of ownership shall be borne by the allottee on actual basis.
 
The management of the building will be operated by the Owners Society or Bashati Management Ltd. Each allottee must initially deposit an amount to the Owners Society or Bashati Management Ltd for maintenance expenses of the building which will cover maintaining and repairing of common areas, water tanks, electrical mains, lifts, water pumps, generator, water leakage, external painting and cleaning (every 5 to 10 years), supplying uniforms to the staffs of the complex, etc.
 
Monthly Service Charge
The allottee is liable to pay Tk............................. per month to Bashati Consortium Ltd as service charge to cover common services (security, cleaning, garbage disposal, common electricity/water/sewerage/gas, lift(s), intercom, generator, caretaker, electrician, liftman, etc) from the date of taking physical position or the key of the apartment till the complex is officially handed over to Owners’ Society or Bashati Management Ltd.
